RVYield Terms of Service

These Terms of Service ("Terms") are an agreement between you and Dorff Ventures LLC, a Wisconsin limited liability company doing business as RVYield ("RVYield," "we," "us," or "our"). They govern your use of rvyield.com, the RVYield host portal, our free estimate tool, our emails, and our related services (together, the "Service").
By creating an account, checking a box to accept these Terms, completing a purchase, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you are accepting on behalf of a business, you confirm that you have authority to bind that business, and "you" means the business. If you do not agree, do not use the Service.
1. What RVYield is
RVYield is a software subscription for businesses that rent out RVs, campers, and travel trailers. It identifies high-demand events near your hub and gives you recommendations for each of your rigs. These can include nightly rates, minimum stays, date windows, fee and add-on suggestions, and listing text (together, "Recommendations").
2. Recommendations only: we never touch your listings
- RVYield does not log into, access, list, price, book, message through, or change anything on your accounts with Outdoorsy, RVshare, RVezy, or any other rental marketplace or booking site (each a "Marketplace").
- Calendar sync, where available, is read-only. We read only the calendar export links you choose to give us.
- You decide whether to use any Recommendation, and you make any changes to your listings yourself.
- RVYield is not a marketplace, booking agent, broker, or travel service. We do not take reservations, collect money from renters, or take part in any rental.
- RVYield is not affiliated with, endorsed by, or sponsored by any Marketplace, or by any event, venue, or organizer we mention. Their names and trademarks belong to their owners.
- You are responsible for complying with each Marketplace's terms and policies, including its rules on fees, minimum stays, and off-platform bookings.
3. Eligibility and accounts
- The Service is for businesses in the United States. You must be at least 18 and use the Service for business purposes, not personal or household purposes.
- You must give us accurate information and keep it up to date.
- Keep your login credentials confidential. You are responsible for activity under your account. Tell us promptly at support@rvyield.com if you believe someone has used your account without permission.
- Each account is for one business. Do not share your login with anyone outside your business.
4. Rigs
- Your subscription is priced per rig. Each rig profile must represent one real vehicle or trailer that you own or manage and offer for rent. Do not use one rig profile for several vehicles, or swap different vehicles in and out of a profile.
- Recommendations depend on the details you give us, including your baseline nightly rate. Inaccurate details produce inaccurate Recommendations.
- To protect the Service, we may limit how often you can change a rig's baseline rate and other key details, and we keep a record of those changes.
5. Your decisions and responsibilities
- Recommendations are estimates based on public information, third-party data, our methods, and the details you provide. They are not guarantees of demand, bookings, rates, or income.
- Events can be canceled, rescheduled, or smaller than expected, and event details come from third parties.
- Some Recommendations and listing text are written with the help of AI and may contain mistakes. Review them before you use them.
- Any examples of possible earnings on our website or in our emails are illustrations. Your results depend on your rigs, location, pricing, marketing, and market conditions, and many hosts will earn less.
- You alone are responsible for:
- the rates, fees, terms, and listing content you publish;
- your rental agreements and your renters;
- insurance, permits, licenses, and any lodging or sales taxes;
- the delivery, setup, and safe operation of your rigs; and
- complying with the law and with event, venue, and campground rules. Some events restrict delivered or rented RVs or require passes.
- RVYield does not provide legal, tax, insurance, or financial advice.
6. Estimates before you subscribe
Our free estimate tool, and any emails we send before you subscribe, give rounded ranges for a class of rig. They are not Recommendations for your specific rig, and they are for illustration only.
7. Subscriptions, billing, and renewal
- Paddle is our reseller. Our order process is conducted by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles billing, taxes, payment inquiries, and refunds, and Paddle's buyer terms also apply to your purchase.
- Pricing. You pay for each rig on your subscription at the rates shown on our pricing page when you buy. The rate per rig goes down as your fleet grows. Fleets of 16 or more rigs are priced by custom quote. Prices do not include applicable taxes, which Paddle calculates and collects.
- Monthly and annual plans. Monthly plans are billed each month. Annual plans are billed once a year at a price equal to ten months of your monthly price, for twelve months of service.
- Automatic renewal. Your subscription renews automatically at the end of each billing period, and Paddle charges your payment method on file at the price then in effect, until you cancel. For annual plans, we will email you a reminder at least 15 days before each renewal.
- Cancel anytime. You can cancel at any time using the "Manage subscription" link in your Paddle receipt, or by emailing billing@rvyield.com from the email address on your account. Cancellation takes effect at the end of your current billing period, and you keep access until then. Refunds are covered by our Refund Policy.
- Changing your number of rigs. Adding a rig raises your subscription price right away, and you are charged a prorated amount for the rest of your current billing period. Removing a rig lowers your price starting with your next billing period; we do not issue credits for the current period.
- Price changes. We will email you at least 30 days before a price increase applies to you. The new price takes effect at your first renewal after that notice period, and you can cancel before then.
- Failed payments. If a payment fails, Paddle may retry it, and we may suspend your access until payment is made.
8. Acceptable use
You agree not to do any of the following, and not to help or allow anyone else to do them:
- Access, collect, or copy any part of the Service by automated means, including robots, spiders, crawlers, scrapers, scripts, headless browsers, or data-mining tools. This does not apply to your email software reading emails we send you.
- Reverse engineer, decompile, disassemble, or otherwise try to discover or reconstruct the source code, algorithms, formulas, models, multipliers, thresholds, rules, or data behind the Service, Recommendations, or estimates.
- Submit fictitious, test, or systematically varied information, such as made-up rigs, baseline rates, locations, or email addresses, to probe how Recommendations or estimates are calculated.
- Create multiple accounts or use multiple email addresses to get around usage limits, or bypass rate limits, bot checks, or other security measures.
- Share, sell, resell, publish, or distribute Recommendations, reports, digests, or estimates, or use them for rigs that are not on your subscription, except as Section 9 allows.
- Use the Service or anything it produces to build or improve a competing product or dataset, or to train AI models.
- Share your login credentials with anyone outside your business, or let others use your account.
- Interfere with, disrupt, or overload the Service, or try to gain unauthorized access to it or its systems.
- Use the Service for anything unlawful, deceptive, or harmful.
We may investigate violations and suspend or terminate access. We may also take legal action, including asking a court for an injunction.
9. Confidentiality and trade secrets
Recommendations, reports, digests, estimates, our methods, and the non-public parts of the Service are RVYield's confidential information and include our trade secrets.
You may use Recommendations for the rigs on your subscription. That includes publishing the rates, minimum stays, fees, and listing text you choose in your own listings and rental agreements. Otherwise, you must keep our confidential information confidential and use it only to run your own rental business. These obligations continue after your subscription ends.
10. Ownership and licenses
- Our property. We own the Service, including its software, methods, event data, Recommendations, content, and trademarks. As long as you follow these Terms and pay for your subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during your subscription.
- Your data. You own the information you give us about your business and rigs ("Host Data"). You grant us a license to use Host Data to provide, secure, and improve the Service, as described in our Privacy Policy.
- Aggregated data. We may create and use aggregated or de-identified data that does not identify you, your business, or your rigs. We own that data.
- Listing text. You may use, edit, and publish the listing text we generate for you. Because it is generated from rig and event details, we may generate similar text for others.
- Feedback. If you send us ideas or feedback, we may use them without any obligation to you.
11. Third-party services
The Service relies on third parties, including Paddle, our hosting provider, and public data sources, and it refers to Marketplaces and events we do not control. We are not responsible for third-party services, and their own terms govern your use of them.
12. Disclaimers
THE SERVICE, RECOMMENDATIONS, AND ESTIMATES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THIS INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RECOMMENDATIONS WILL BE ACCURATE OR COMPLETE, THAT THEY WILL PRODUCE ANY BOOKING OR INCOME, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
13. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- RVYIELD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
- RVYIELD WILL NOT BE LIABLE FOR ANY LOST PROFITS, REVENUE, BOOKINGS, DATA, OR GOODWILL, OR FOR ANY PENALTY, SUSPENSION, OR REMOVAL IMPOSED BY A MARKETPLACE, ARISING FROM THESE TERMS OR THE SERVICE.
- RVYIELD'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.
These limits do not apply where the law does not allow them.
14. Indemnification
You will defend, indemnify, and hold harmless RVYield and its owner, employees, and contractors from any third-party claim, including claims by renters, Marketplaces, or government authorities. This covers claims, and the losses and reasonable attorneys' fees that result, arising from any of the following:
- your rentals, listings, or rigs;
- your Host Data;
- your use of the Service; or
- your violation of these Terms or the law.
15. Suspension and termination
- You may stop using the Service at any time by canceling under Section 7, and you may ask us to delete your account as described in our Privacy Policy.
- We may suspend or terminate your access if you violate these Terms, fail to pay, or create risk or legal exposure for us or others. If we terminate your access because you violated these Terms, you are not entitled to a refund.
- We may discontinue the Service, or any part of it, with notice. If we discontinue the entire Service, we will refund the unused portion of any fees you prepaid.
- Sections 8 through 14, 17, and 18, and anything else that by its nature should survive, continue after these Terms end.
16. Changes to the Service and these Terms
We may change the Service over time. We may also change these Terms. We will post the updated Terms with a new effective date.
For material changes, we will give you at least 30 days' notice by email or in the host portal before they take effect, and we may ask you to accept them. If you do not agree to a change, cancel before it takes effect. A change to Section 17 does not apply to a dispute that arose before we gave notice of the change.
17. Disputes: governing law, arbitration, and class waiver
- Governing law. These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. The Federal Arbitration Act governs the arbitration provisions below.
- Try to resolve it first. Before starting arbitration, the party with the dispute must send the other a written notice describing it. You send notice to admin@rvyield.com; we send notice to the email address on your account. Both parties then have 30 days to try to resolve the dispute informally.
- Binding arbitration. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration before a single arbitrator, administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will take place in Portage County, Wisconsin, or by video or written submissions if both parties agree.
- Exceptions. Either party may bring an individual claim in small-claims court if it qualifies. Either party may also ask a court for an injunction or other equitable relief to stop unauthorized access to, scraping of, or use of the Service, or to protect intellectual property, confidential information, or trade secrets.
- Individual claims only. Disputes will be resolved only on an individual basis, not as a class, collective, consolidated, or representative action. YOU AND RVYIELD EACH WAIVE THE RIGHT TO A JURY TRIAL.
- Courts. Any dispute that is not arbitrated will be heard only in the state or federal courts serving Portage County, Wisconsin, and both parties consent to their jurisdiction.
18. General
- Entire agreement. These Terms, our Privacy Policy, our Refund Policy, and your order details make up the entire agreement between you and RVYield about the Service.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of our business or assets.
- Severability and waiver. If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it.
- Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, including outages at our service providers.
- Relationship. You and RVYield are independent contractors. These Terms do not create a partnership, agency, or employment relationship.
- Notices and electronic communications. We will send notices to the email address on your account. You agree to receive agreements, notices, and other communications from us electronically. Send notices to us at admin@rvyield.com or to the mailing address below.
